1. Acceptance of Terms
By accessing or using the HomeAI App, provided by Wompa Labs LLC, ("HomeAI," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and any additional guidelines or policies referenced herein. If you do not agree, you may not use HomeAI.
2. Description of Services
HomeAI is an AI‑powered platform that empowers homeowners and service providers to visualize, plan, and manage home‑improvement projects. Core features include but are not limited to:
- Photorealistic before‑and‑after visualizations for interior and exterior spaces.
- AI‑generated design suggestions, material palettes, and cost estimates.
- Project management dashboards, collaboration tools, and provider matching.
- Subscription‑based premium features, API access, and business dashboards for pros.
3. Eligibility & User Accounts
- Age & Capacity. You must be at least 18 years old and capable of forming a binding contract.
- Account Security. You are responsible for safeguarding login credentials and all activity occurring under your account.
- Accurate Information. Provide true, current, and complete information and keep it updated.
- Unauthorized Use. Notify us immediately of any breach or unauthorized access.
4. Acceptable Use
You agree not to:
- Upload or generate content that is unlawful, infringing, defamatory, hateful, or otherwise objectionable.
- Reverse‑engineer, decompile, interfere with, or disrupt any part of HomeAI or its underlying models and infrastructure.
- Misrepresent your identity, create multiple accounts to evade limits, or share accounts.
- Use output to develop competing AI models or datasets.
- Violate applicable laws, regulations, or third‑party rights.
5. AI Services & Limitations
- Informational Purpose Only. AI outputs (designs, visualizations, cost estimates) are suggestions not professional architectural, engineering, or financial advice.
- Variability. Output quality depends on image resolution, lighting, and data quality.
- Feasibility & Compliance. AI does not assess structural integrity, building codes, or regulatory compliance. Consult licensed professionals before construction or purchasing materials.
- Training & Improvement. We may use anonymized usage data to improve our models in accordance with our Privacy Policy.
6. User Content & License
- Ownership. You retain all rights to images, descriptions, and project data you upload ("User Content").
- License to HomeAI. You grant HomeAI a worldwide, non‑exclusive, royalty‑free license to host, process, modify, and display User Content solely to operate and improve the Services.
- Public Sharing. When you choose to share renderings publicly or with trusted pros, you grant HomeAI permission to display them to those audiences.
7. Intellectual Property
All intellectual‑property rights in HomeAI—including software, algorithms, interfaces, and AI‑generated templates—are and remain the exclusive property of HomeAI or its licensors. Except for the limited rights expressly granted, no license is conveyed.
8. Privacy & Data Protection
Your privacy is important to us. Our collection and use of personal data are described in the HomeAI Privacy Policy, which forms part of these Terms and complies with applicable data‑protection laws (e.g., GDPR, CCPA).
9. Fees, Payments & Subscriptions
- Billing. Subscription fees are billed in advance on a recurring basis until canceled.
- Trials. Trial periods convert to paid plans unless canceled before the trial ends.
- Refunds. Except as required by law, payments are non‑refundable.
- Taxes. Fees are exclusive of taxes, which you must pay where applicable.
10. Third‑Party Services & Integrations
HomeAI may integrate with third‑party services (e.g., material vendors, AR viewers). Your use of such services is subject to their terms, and we are not responsible for their performance.
11. Disclaimers
HomeAI is provided "as‑is" and "as‑available" without warranties of any kind, express or implied. We do not warrant that outputs will be accurate or meet your expectations, or that the Services will be uninterrupted or error‑free.
12. Limitation of Liability
To the maximum extent permitted by law, HomeAI and its affiliates will not be liable for indirect, incidental, or special damages. Our total liability shall not exceed the greater of (a) amounts you paid in the prior 12 months or (b) USD 100.
13. Indemnification
You agree to indemnify, defend, and hold harmless HomeAI, its officers, directors, employees, and agents from and against all claims arising from your use of the Services or violation of these Terms.
14. Termination & Suspension
We may suspend or terminate your account if you breach these Terms or if required by law. Upon termination, your right to use HomeAI ceases immediately, but Sections 6–15 will survive.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, USA. Disputes will be resolved through binding arbitration under the rules of the American Arbitration Association.
16. Changes to the Terms
We may update these Terms periodically. Material changes will be communicated at least 30 days in advance. Continued use after the effective date indicates acceptance.
